Brand X historically loves a good joke, but this is no laughing matter: this is our life's labour. A merchant account is trying to mimic our image and steal our band.

After more than a year of watching his band’s name, and his legacy of nearly 50 years of musical history, as well as his achievements hijacked and dangled before Brand X‘s fans by a rogue management company which Percy Jones has severed ties with, he is joined by band mate and co-founder of Brand X Robin Lumley, in an open letter, a plea, to all the fans of Brand X and the Music Press: 

A social media avatar calling itself “Official Brand X” on Facebook, YouTube, Twitter, and Instagram has been crowding our band’s airspace, and cramping our style by taking our identity, while inserting themselves at the center of self-serving circular stories inside of a dried up, sterile, phony narrative. These former managers of our band do not represent Brand X. They are not our band, they do not own our music, our name, our logo, and do not have our support or approval to use our creations or our identity. They are not “official” in any sense of the word! They are a lingering parasite in our midst.

Dear loving fans, members of the Press, music lovers, save BRAND X!

I am Robin Lumley of Brand X.

Impostors have been acting as Brand X online for some time and speaking in our name, calling themselves “Official” on social media, including Facebook and Twitter. They have been selling music we wrote and T-shirts claiming to be sending money to the musicians.

I never gave my consent to letting these people work with Brand X, and the tentative contract they signed is expired.

Please do not support these band snatchers. There is only ONE Brand X: Percy Jones, John Goodsall and myself. Our dear John passed away and these unscrupulous businessmen have angled to take our band’s work and our name.

I oppose this, and I ask you to support me, my family, Percy Jones, and his family, and John Goodsall’s family and next of kin, in our effort to put an end to this charade.

They address you online, but they are not “us” – it is not Brand X (this isn’t too hard to figure out, if you think about it.)

One of these managers was overheard bragging that his name was entered in Wikipedia under Brand X, and another of them was overheard saying “It doesn’t matter who’s in the band as long as we control the brand.”

Well, it DOES matter. It matters to me, it matters to Percy, and it should matter to you, dear fans.

Soon, they will try to reform our band and tell more lies and sell more music and merchandise using our brand and reputation. Do not let it happen, do not support them, do not encourage them.

Percy and I retired Brand X, our band. My hope is that you will throw your support behind Percy. Come to him for information about the future of our band. There’s a film being made about Brand X, which we’ve all worked on, and which we eagerly await; you’ll have a chance to learn all our secrets and it will be an opportunity to say our proper farewell to Brand X.

Here are 22 KEY FACTS & REMINDERS to our fans, the music Press, and Wiki editors:

  • Percy is the boss of Brand X:  with John’s passing, the ownership of Brand X is in the hands of his remaining co-founders of the band and their next of kin. Robin St John Lumley and Percy Jones. Percy and Robin may not be all ego and swagger, but make no mistake, they don’t suffer fools gladly.
  • If you were told that “Percy Jones left Brand X”you were lied to: guess where and by who? Percy refused to work with these managers because he objected to their practices. Their contract has now expired (see below).
  • Our former management (2016 – 2021) no longer manages Brand X, nor do they act on our behalf.
  • Here, on this website, you find ACTUAL members of the band Brand X
  • Robin & Percy are grateful for the fan pages dedicated to their band on social media. Operative words: “fan pages”.

  • Since the passing of John Goodsall, Percy, Robin and John’s family remain the sole authority on Brand X‘s future.

The names and epithets he reserved for them cannot decently be quoted here, because they were so charged and offensive, but it is grotesque that they continue to describe him as their “friend”. John was broke, had a lot of dependencies, and needed their money for rent and medical bills. That is all. 
  • In a gross miscalculation of our band’s legal situation, these unsavory, self-promoting types on Facebook have, from the very beginning, angled to take control of the narrative on our band Brand X. OUR band
  • That means it is not “their band”.
  • Performing Brand X compositions on stage doesn’t make someone a member of Brand X. Booking concerts for Brand X on a US circuit doesn’t make someone part of Brand X.
  • Nor does printing unauthorized T-shirts that violate the 1975 copyrighted Brand X logo without permission.
  • Posting on Facebook and misusing pronouns such as “we” doesn’t make someone Brand X.
  • Brand X are John Goodsall, Percy Jones and Robin Lumley; no one else
  • Percy & Robin, as the only Brand X, reject “Official Brand X” on Facebook, and in their various mercantile exploitations of Brand X on social media platforms, speaking and acting AS IF they were the genuine band Brand X. (These businessmen registered a company named Brand X Live , LLC to exploit a similarity in our names.)
  • If these merchants keep pretending to be our band, or give you jobs, or sell you a bridge, or just merch, they’re not Brand X.
  • When you buy from them, Percy has no idea where the money went: it didn’t go to Brand X.
  • Anytime you support these cloaked social media operators, you hurt Percy Jones, Robin Lumley, and their families as well as John’s.
  • They present a Goodsall-centric fantasy version of Brand X, purposely ignoring our band’s multifaceted and populated creations over 47 yearsbecause our departed acolyte and bandmate can no longer call them out, and they have no friends among actual former Brand X associates. None!
  • Brand X is here. This is where the band Brand X makes its announcements. Nowhere else. Members of the music Press, take note!
  • We’re not going to tell you what to do, but we’re certainly UNFOLLOWING THEM and UNSUPPORTING THEM and casting them out from our band’s aura and perimeter. May they never dirty our towels again!
  • Percy and Robin recommend these people take-up arts and crafts, or a pottery class perhapsand make something of their own if they want recognition: what a novel idea! But Brand X is not their toy, or their vehicle, or their work, or their legacy. May they keep their stubby, greasy, filthy paws off our band and our name. They can go create their own music! They’ve worn out their welcome! Scram!

PERCY AND ROBIN ARE NOT HAVING IT; THEY'RE SICK AND TIRED OF THEM.

These former managers, like something stuck to the bottom of our shoe, have abused our band’s name on Facebook, abused our reputation and identity, all the while locking us out. 

“On the Internet, nobody knows you’re a dog”. Do you think you’ve been talking to Brand X when you swap your loving recollections about our gigs? Who do you think engages you with the patronizing double-speak, and absurd stories about Goodsall’s ghost appearing in puddles? Please! There’s never been a single musician we would describe as “Brand X” behind that keyboard: read our bio section and remind yourself who the people are who create the music! You’re being sold T-shits and downloads while we’re locked out of the account. 

They recently professed to have sent a notary public to a hospital to wrestle a deathbed will  from the clenched fingers of our guitarist and co-founder John Goodsall, as he laid intubated, dying of Covid-19. A will, they say, that conveniently hands the band over to them. Whatever scheme they’ve cooked up, let that be their karma…

To be clear: Robin Lumley and Percy Jones have NEVER bequeathed anything to these people and have NO INTENTION of relinquishing anything to them. Not our music, not our name, nor our work going back half a century. Percy, John, and Robin signed into Brand X in 1975 as a triumvirate and have never shared control of their creation with an external entity, let alone given that creation away. The multitude of players who performed and recorded in our band were not owners of our creation, any more than they owned our name, reputation, or legacy. 

The circling birds are waiting for us to die so they can act unimpeded: let this stand as a record of our stance: WE ARE BRAND X, THEY ARE NOT, AND WILL NEVER BE.

If you support and love Brand X, if you respect Percy and Robin, you cannot also support their activities, and encourage them: please, think this through. 

They exist to hurt us and attempt to take our band’s identity and colonize Brand X and occupy it with anyone they please, beginning with themselves. They understand nothing about us, our style, our humour and derision, but most importantly, our music (we’ve had plenty of opportunity to hear that up close, and our ears are still ringing). This is an occupation, an invasion, and a territorial grab. Sadly, it isn’t the first time in our career that we have attracted predators. And if you know anything about the music business, it isn’t the first time that musicians are taken for easy meat by money guys, dealmakers, agents, middlemen, impresarios, big fat egos, and all the rest. 

Musicians are often penniless and defenseless in the face of ruthless business practices, just as John Goodsall was much of his life. Just as we are. Percy had been John’s friend through thick and thin for nearly 50 years and has seen it all before. It’s the oldest story in the book and everyone knows it. 

Robin and Percy are at an age when this shit isn’t funny. We count on our fans to stand with us and help us put an end to this mummer’s farce. Members of the Press, you love a good scandal: you can help us too. 

Now that we’ve put this out: they will retaliate, slander, attack, revile, fling mud, and lie… all in hopes of distracting from the fact that they are NOT Brand X and have no business taking over our band as they have, and squatting our Brand X

UNFOLLOW, UNPURCHASE, and CANCEL THESE GUYS. THEY ARE NOT US, AND THEY DO NOT REPRESENT US. THEY DO NOT REPRESENT OUR BAND: BRAND X.

For the record, the excerpts below show the legal signatures of Norman Bedford and Scott Weinberger conceding to a contractual restriction blocking them from what we predicted would be an attempt on their part to divide the band in order to take control of it. That restriction contained ONE very specific instance of termination of contract: the death of a member. They are mandated by their own signatures to cease all activities on behalf of Brand X

After being repeatedly challenged on false information they published and after they deleted user comments confronting them about the illness of our band mate John, back peddling ensued and eventually “Official BS” conceded to revise some data. Percy obtained this certificate from the coroner’s office in Minnesota when John’s body, which had been abandoned at the Mayo Clinic, was retrieved so it could travel to California. A generous fan supported crowdfunding effort helped pay to return John to California so his daughter could bury him. 

Needless to say, the former managers weren’t invited to the funeral.  These are the facts.

This has been: Percy and Robin are not having it!

Percy and Robin don’t even know what the hell these people are thinking, taking our name, our band, our work, and passing themselves off a us, speaking to fans as “Brand X‘s own” congratulating each other in some circle jerk… You don’t barge-in and confiscate people’s work, their art, their lifelong achievement, their name, or their band, like you’re a cop on a civil forfeiture rampage. Our band is not their toy to play with. What humans behave this way? And WHY are people following them and egging them on?

These social media foragers who are taking our name, our reputation, our legacy, are not permitted to use the pronoun “we” when describing our band and our history. They are not Brand X. WE ARE!

Percy Jones and Robin Lumley, the founding members of Brand X, are being trolled: bassist Percy Jones is locked out of his own band’s social media accounts by a pair of East Coast, toupee-wearing impresarios who were told in no uncertain words to leave, and hand over the passwords, and who, instead of complying, are continuing to pose as Brand X on Facebook and other social media, deceiving fans of our (nearly 50-year-old) band with phony recollections of bygone days which they never experienced and know nothing about. They are using “Official Brand X”, “Brand X store”, on Facebook and other social media, and yet, they’re NOT.  

Brand X are the property of three musicians, and their next of kin, who determine their own band’s fate. Brand X are John Goodsall, Percy Jones and Robin Lumley together. NO ONE ELSE!

16k Facebook followers are being fooled; when you follow Facebook’s Official Brand X, all you get is a fellow in a WIG describing his own fantasies in the third person; not Brand X. Brand X doesn’t like those guys.

Jazzers: The quote: “others understood you could rock it with melodies” – This is a direct hit at Percy, who, back in the day, staunchly defended the integrity of the musical style Brand X was committed to from the start of our mission. Here’s what actually happened: John shared Percy’s concerns, yet didn’t have the heart to affront Charisma Records, or Tony Smith, who had been footing the bill for many of his dramatic excesses. John diplomatically, and largely out of guilt, conceded to work both night and day crews in 1979 in order to appease everyone: he wrote the lyric to “Don’t Make Waves” illustrating the matter. We know this because we were there. “Jazzers” is used, here, as a derogatory term suggesting Percy was mistaken holding the line. The reference to “melodies” is another hit job suggesting that Percy doesn’t do “melody”. Bedford, who apparently once played a bass, has also been screen-captured complaining online that Percy had “no groove”, was “just one of several bass player in Brand X“, and “left the band”. All of which are false. (If you see a pattern emerging, we feel for you!)

…And still be Brand X”: Bedford is a man who said “it doesn’t matter WHO is in the band; we control the brand”. What would this businessman/alleged manager know about “what it means to be Brand X” since it is not his band, he wasn’t there, doesn’t have our approval, signed out at the death of our guitarist, and keeps on grabbing at ownership of our name? 

More to the point, Bedford, in the seduction phase of his affiliation with Brand X was quoted telling Percy and John: “Don’t worry, I’m not going to screw you.”

Aside from grasping at straws sharing “old memories of bygone days”, Norman Bedford (who wasn’t anywhere near Percy or John before 2016) doesn’t manage Brand X any longer, although his admission (like Napoleon Bonaparte, writing about himself in the 3rd person) does indicate he has no intention of abiding by the demands of Percy and Robin to let Brand X rest. Robin and Percy do not want him around! He suggests he manages a ghost ship devoid of any of the founding, co-owners of Brand X, and that those founding co-owners are irrelevant. Like the Golem, he wants the “Precious“. Bedford has nothing to manage in Brand X (not his band) for Percy and Robin, or for John’s next of kin and is not reporting to Brand X. Bedford needs to return the passwords to the official accounts on social media, which he and his accomplices are hogging. By his own signature, he acknowledges that he was terminated at the passing of John Goodsall. Furthermore, he acknowledged that he may not and cannot supersede Percy’s dominion over the band. In addition, Percy fired him (and his sidekick).

Moreover, these individuals don’t seem to factor-in Robin Lumley’s standing co-ownership of Brand X. The delusion runs deep. Robin is still, also, an owner in Brand X. It’s his music too. Brand X‘s publishing and mechanical rights remain with manager Tony Smith of Hit & Run, and again, Bedford has no position, and isn’t recruited for one. To Bedford, Brand X suggests taking-up “knitting”.

Percy Jones is a clear target of this stressful, passive-aggressive attack on his work and his band.

Pulling the lid off the management debacle of 2020/21:

"It doesn't matter WHO's in the band, we have the brand!" "Don't tell Percy anything about John's illness!"

…and other ludicrous quotes overheard from the bowels of the business. (Plus an explanation of the drama behind the scenes.)

It’s impossible to give a sense of the grotesque, bottom dwelling behavior that Percy had to contend with from the moment he protested his treatment inside the bubble. No accounting, ongoing disrespect of he and John, mockery, and in the end, Percy’s own band and legacy was paraded in front of the public, falsely represented, as if it were no longer his own… 

One down, two to go: their plan appears to be to wait-out Percy and Robin, hoping both of them will die off soon so they can proceed.

One of the main reasons why it is necessary to let our fans know all the details contained on this page is that the Facebook front has been usurped to conduct a passive aggressive campaign of spin to bend appearances about Brand X in order to erase the original musicians of the band from the public’s awareness. 

Did Percy Jones leave his own band, Brand X in 2020?

  • No. Percy Jones did not leave Brand X, not then, nor at any other time, nor did he leave his own stakes in Brand X, nor did he abandon half a century of his work into the hands of some short-lived management. as Brand X, Percy and John have had to contend with 4 decades of people trying to shoe them out of their own band: they can see them coming! Percy made it clear in public statements and magazine interviews that he refused to empower the former managers to use him to continue their exploitation of the Brand X name and its brand. In short, he refused to allow them to manage him. He refused to play as long as they were pushing John into continuing. Contrary to repeated claims by the phantoms acting as “Official Brand X” on Facebook, Percy Jones did not “leave his own band”. The management itself is released of its duties. They’re unwanted. They’re redundant. They are sacked!
In 2021, Percy received a distressed warning from John’s daughter that the Mayo Clinic in Rochester MN declared no one claimed John after he passed away. As his next of kin, only she could act. With only days to go, Percy and Natasha scrambled to organize the return of John’s remains to California so a burial could take place; this led to a “go fund me campaign” which made it possible to give John a proper burial.  This official record obtained at the time of the retrieval of John’s body confirmed some elements which later challenged the false information that appeared on social media. 

In 2021 the Facebook page falsely identifying as “Official Brand X” claimed he did not have Covid (until they were called out on it): Was John Goodsall indeed hospitalized to recover from “pneumonia”?

  • John died in hospital on 10/11/2021 after weeks of intubation and a tracheotomy after he contracted Covid-19.

Why do they erect this ghoulish shrine to the ghost of John Goodsall and only fantasize about him as if they were his friend?

  • Dead men can’t talk back. They should know, because John gave them enough lip and grief when he was alive. Of course John was an indispensable co-founder of our band. And of course John was in a band with us: a band with other musicians, composers,  and an array of great session players. Brand X is not one person. To be exact, Brand X is three people on the books: Robin, Percy, and John
  • Was John Goodsall their “friend” as they claim? Was he desperate for their handouts? Is that the same? We recommend you ask John’s family, friends, and former musical mates, across social media to tell you the truth about John’s feelings on the matter. It’s the same truth many fans have been privately messaging each other every time “Official Brand X on Facebook” publishes some ludicrous, self-aggrandizing drivel about their own importance. 
  • When John Goodsall’s daughter needed to start a Crowdfunder in order to repatriate John’s body and hold a proper funeral, did they even concede to using their exposure to 16,000 followers to help publicize it? No they didn’t. They sold t-shirts. 

Was a notary public sent to John’s hospital bed to officiate a predated will, conveniently bequeathing the band and its operations to former managers who were contractually forbidden from extending their play, as was marginally suggested? To what end? 

  • On the one hand, this aberration is a legal irrelevancy (see above documents): in addition, Percy and Robin have not agreed to letting these people take away the band from them. The copyright attributions to Brand X all remain in place and no one is going anywhere with them. Hit & Run Publishing still handles the majority of the rights on Brand X‘s creations, and neither the name nor its copyrights have been transferred away. 
  • On the other hand, you can work out how anyone who’s broke, an insurance liability, and dying from organ failure after contracting Covid-19 can be viewed as easy pickings. But it’s interesting to see that the entity Brand X is the subject of such envy that people who spend all their life counting money have set their sights on running off with the work. 
  • Percy was by far John’s most faithful ally for nearly half a century, and stuck by him even in the worst of times (more on that later). From his (almost) 50-year friendship with Percy Jones, there’s nothing in John Goodsall’s life, save manipulation, dependency, pressure, and lowly dealings, that would motivate him, in his last moments, to turn is back on his friendship, and ditch his part of the work into the hands of people he privately had no kind words for. His family, and friends, know it all too well for having heard it enough times: John knew that he needed their handouts: all their self-congratulation is calculated and ludicrous. It’s all a show. As for his own words on the “percussion issue”, we’ll post more on the topic if they insist.
  • When John was hospitalized, in the fall of 2021, several people, including members of John’s family directly reported to Percy that their alleged manager instructed them to keep Percy in the dark about John’s true condition, or, to quote them: “don’t tell Percy anything”. Let that sink in, then read this sentence again! (Quick note: those managers, despite hanging on, have been sacked!)

  • Needless to say: they were not invited to John’s funeral ceremony.

 As Percy put it: “this story keeps getting darker!”

Does Percy Jones see money from sales of merchandise, including downloads on platforms like Bandcamp?

  • Since he decided to get rid of Norman Bedford and Scott Weinberger, Percy Jones has not seen a single sheet of accounting. In fact, the complete absence of accounting going back to the beginning of the 2016 reunion was the main reason for his decision to sever the relationship. During the tours, the lack of accounting on T-shirts and CDs was blamed on the carelessness of their vendor. Last year, Burning Shed apologetically reported to Percy sending upwards of £30,000 in sales of Brand X CDs and Blu-Rays to a US account. Percy had never heard of that money. He hasn’t seen a penny of it. 
 Did Percy or Robin approve of the failed attempts to add various musicians (bass players, drummers) to the list of session players in Brand X since 2020?
  • No. Several of the musicians who were “announced” as replacements were professionals, and reached out to Percy to find out the dirt. As soon as they were informed of the situation, they pulled out; hence the seeming chaos over at “Official Brand X on Facebook” Percy and Robin at this stage would be the only people who can accept members into Brand X. And they won’t. Any such decision would require the agreement of all three members of Brand X. To reiterate: the paper trail, going back to the formation of the band in unequivocal: Brand X is only John Goodsall, Percy Jones, and Robin Lumley. No one else is Brand X.

What does the phrase “Brand X’s own” mean?

  • Nothing! When you read some online propaganda claiming to congratulate some “Brand X’s own” for something, please know that Brand X’s own are only John Goodsall, Percy Jones and Robin Lumley. Nearly five decades of financial debt to Hit & Run music bind these men to the sole ownership of Brand X, the band. There is no other Brand X, least of all “Brand X’s own”.

Why are “they” maintaining this mummer’s farce?

  • Out of spite, most likely: they HATE Percy Jones because he told them off and exposed them.  Percy also muscled them into signing a contractual clause that immediately removed them from any dealings with Brand X in the event of the death of one of the members. They may well be waiting for Percy and Robin to die – to croak – to kick the bucket — so they can act unimpeded and make more claims to a territory that isn’t theirs, claiming the band’s legacy to use it as a sideshow. They may be eyeing half a century of creations they wish to use to stuff their faces and attempt to go on the road as a tribute band, bamboozling fans who think that, in some way, they can still catch a glimpse of the past. Let’s be clear: these people have nothing but the ire and contempt for the members of Brand X. John did not like them either, despite the grotesque claims of being their “beloved guv’nor and friend ” (a claim that’s emetic to anyone who knew John and what he had to say about these people), and certainly, Percy and Robin do not want them acting as Brand X. Not now, not ever.£

Fans: know when you’re being manipulated!

  • Who do fans think is talking to them on that Facebook page? Who is selling them t-shirts and downloads?Some people in their underwear eating at their computer they’ve never heard of, no doubt… people whose musical aptitude is of no interest to Brand X fans. People who regurgitate stories we’ve told them about the past and getting most of them wrong, purposely or not… who even knows? The only people who can speak to you as Brand X are here, on this website: Percy and Robin. If a text somewhere online is not from Percy or Robin, it’s not Brand X. Brand X is here, at this website!

What do the REAL surviving musicians of Brand X, Percy and Robin, want out of this?

  • Brand X , our band, want these people to vanish from anything with the Brand X name on it. May they go create their own musical legacy with the skills the good lord has bestowed onto them, and may they leave other people’s work alone.

 Fans, journalists of the rock music press, session musicians, Reddit and Wikipedia editors: please take note!

  • And there’s a lot more material on these characters that Percy and Robin have collected. We’ll see how things escalate. Brand X is honored to have fan pages online. Please continue to promote our music, but please, stop promoting the attack on Brand X by placating this fraudulent representation of our band, and by sharing their posts. Please act as if you know right from wrong and stand with us.

 

And if these Ringling Brothers (as John called them) should ever go back out on the road as Brand X, know that they’re wrecking our name, and doing exactly what we told you we didn’t permit.

DON’T ENCOURAGE THEM

Dear fans of John Goodsall, Percy Jones, and Robin Lumley, you can help by withdrawing your attention from these people who clearly are not the Band X which you’ve come to know and love and who created the band, and help put an end to this calamity, this theater of the absurd they’re putting on… Please do not placate these money men, do not even humor them, and please, withdraw your support from their hijacking of Brand X. They’re not “Official”, and they do not have our blessing to operate, to speak on our behalf or to take our work. 

Members of the music Press, Wiki editors, you know who you are: be sure to check all claims with the real Brand X: where the Brand X musicians are located and can answer for themselves. Accept no substitute or treachery.

WILL BRAND X EVER PLAY LIVE AGAIN?

No: Percy and Robin are not permitting it. Short of having their agreement to the contrary, the creators and owners of Brand X should be seen as having been robbed, either now, or posthumously should that happen. Robin Lumley and Percy Jones have made their intensions clear: no one else besides them should try to step in their shoes or play their music under that name or any other.

For now, Brand X is officially retired. This is the Brand X domain and website, and none but Percy Jones and Robin Lumley can claim authority over Brand X, and others may not speak falsely as Brand X.

A HISTORY OF THEFT

Percy, John, and Robin have all, over decades, been the targets of people who attempted to kick them out of their own band. Throughout its history, Brand X has been “the Precious” described in The Lord of the Rings: people have repeatedly lusted after the vehicle, and the band’s reputation, while angling to kick out its musicians, and replace them with generic participants. Is theft considered the highest form of flattery…? Perish the thought: this is contempt for artists, pure and simple.
